Hyderabad: Consumer court directs SLN Construction to pay Rs 25,000 to residents

Hyderabad: Consumer court directs SLN Construction to pay Rs 25,000 to residents

Hyderabad: The Telangana State Consumer Disputes Redressal Commission has ordered SLN Constructions in Kukatpally to pay Rs 25,000 to the Mayuri Meadows Resident Owners Welfare Association, Miyapur, for violations.Out of 66 residents, 59 complained that the corporation made a number of promises but then completely avoided fulfilling them.

Residents claim that RNS Construction, doing business as Mayuri Meadows, received a voucher from SLN Construction that contained all the promised infrastructure. However, despite the residents’ patient waiting, SLN Construction made little progress. A homeowner claims that there hasn’t been access to Manjeera water, a jogging path, a party hall, indoor activities, or a gym.

In a notable judgment, the Telangana State Consumer Disputes Redressal Commission has directed SLN Constructions, based in Kukatpally, Hyderabad, to compensate the Mayuri Meadows Resident Owners Welfare Association with ₹25,000 for deficiencies in promised amenities and construction quality. This decision underscores the legal obligations of builders to fulfill their contractual commitments to homebuyers.

Background of the Complaint

Mayuri Meadows, located in Miyapur, Hyderabad, is a residential complex developed by SLN Constructions. Out of the 66 apartment owners, 59 residents collectively lodged a complaint against the developer, alleging significant deviations from the assured facilities and substandard construction quality. The grievances highlighted the absence of several key amenities that were part of the initial agreement:

  • Manjeera Water Supply: Residents reported the non-provision of the promised Manjeera water connection, compelling them to rely on alternative and often more expensive water sources.
  • Jogging Track: The committed jogging track, intended to promote a healthy lifestyle within the community, was not constructed.
  • Party Hall: A designated space for social gatherings and events, as per the agreement, was missing from the premises.
  • Indoor Games and Gymnasium: Facilities aimed at fostering recreational activities and fitness were notably absent, contrary to the developer’s promises.

Beyond the missing amenities, the residents expressed concerns over the poor quality of the construction work, which raised safety and durability issues.

Commission’s Verdict

After a thorough examination of the claims and evidence presented, the Telangana State Consumer Disputes Redressal Commission found SLN Constructions guilty of service deficiencies. The commission’s directives to the developer included:

  • Monetary Compensation: Payment of ₹25,000 to the Mayuri Meadows Resident Owners Welfare Association as recompense for the inconvenience and unmet promises.
  • Rectification Timeline: A mandate to complete all pending works and provide the promised amenities within a two-month timeframe from the date of the order.

This ruling emphasizes the accountability of builders to adhere to their contractual obligations and ensures that homebuyers receive the facilities and quality standards they were assured.

Implications for the Real Estate Sector

The commission’s decision serves as a precedent, reinforcing the rights of consumers in the real estate domain. Key takeaways include:

  • Enforcement of Promises: Developers are legally bound to deliver all amenities and specifications as advertised and agreed upon in sales agreements.
  • Quality Assurance: Substandard construction quality can lead to legal repercussions, compelling builders to maintain high standards to avoid disputes.
  • Consumer Empowerment: Homebuyers are encouraged to seek legal recourse through consumer forums when faced with grievances, ensuring their rights are protect.

The directive against SLN Constructions by the Telangana State Consumer Disputes Redressal Commission highlights the critical importance of transparency, commitment, and quality in the real estate industry. It serves as a reminder to developers of their obligations and reassures consumers of the legal avenues available to address and rectify grievances related to property transactions.
