Unauthorized construction in Tamil Nadu will result in consequences for officials

MADURAI: The State government has lately been ordered by the Madurai Bench of the Madras High Court to take administrative action against the officials who disregarded an illegal building in a Tiruchy apartment complex.

The court noted that a report on actions taken should be submitted by November 10.
The instructions were given by Justices R Mahadevan and J Sathya Narayana Prasad during the hearing of a plea submitted by G Shanmugasundar of Chennai.

The judges noted that a division bench of the Madras High Court had issued certain directions to the government in July of this year based on the guidelines established by the Supreme Court for handling illegal constructions, including “before issuing building planning permission, an undertaking must be obtained from the builder or applicant…

stating that owners would only be given control of the building after receiving a completion certificate from the authorities.

According to the aforementioned Madras HC decision, the relevant authorities should perform a personal inspection to determine whether there is any departure from the building plan before issuing the building completion certificate.

But notwithstanding these rulings, judges Mahadevan and Prasad recognised that the government did not follow the rules when obtaining planning permission and issuing completion certificates, and they ordered departmental action against the responsible officials. It was postponed till November 10.

According to Shanmugasundar, the building promoter he and his brother hired started constructing businesses illegally after departing from the approved building design.
