The Bombay High Court’s decision granting GAL concession rights to Nagpur Airport is upheld by the Supreme Court

The Supreme Court of India has upheld the decision of the Bombay High Court’s Nagpur Bench, which had previously quashed and set aside Mihan India’s letter cancelling the Nagpur Airport bidding process.

While dismissing the SLPs filed by Mihan Indian, the Maharashtra government, the Airport Authority of India, and the Union of India, the Supreme Court specifically stated that the High Court’s findings allowing GMR’s writ petition are in accordance with law and do not suffer from any illegality warranting Supreme Court intervention.

As a result, the authorities are expected to complete the Nagpur Airport concession agreement with GMR as soon as possible.

In the Nagpur Airport tender process conducted by Mihan India in 2019, GMR emerged as the highest bidder. The award letter was sent out in March of this year. However, in March 2020, the Maharashtra government decided to cancel the tender process, and Mihan India issued a letter cancelling the bid process, which was later overturned by the Nagpur Bench of the Bombay High Court in August 2021, and the Supreme Court upheld the decision.
